The Options Available for Hit-and-Run Accident Victims

Reading Time: 3 minutes

It is normal for individuals who have been in an accident to get anxious and worried. Suppose the other driver refuses to accept responsibility for the accident and leaves the scene of the accident burdened with injuries and a damaged car. In that case, the situation becomes even more frustrating. According to the National Highway Traffic Safety Administration (NHTSA) hit-and-run crashes are common in the United States and occur in at least 11% of all reported accidents.

After a hit-and-run accident, you may wonder about the steps to take to get the compensation you deserve for damages. Here are some actions to be taken:

  • Ensure your safety. Pull your car over where it is out of traffic and away from speeding vehicles if possible. This involves checking yourself and passengers to confirm if anyone requires medical attention. Remember that every injury should be reported to the 911 emergency services.
  • Report the accident. Inform the police immediately, as this can be considered an accident that needs to be reported. Try recalling as much information as possible about the other car. You should be able to identify the following features: make, model, and colour.  In general, it is recommended that you contact the police and provide a report of the event, even if you have few details, to start the process for compensation claims.
  • Gather Evidence. If you can, then snap a picture of the scene, the damage to your vehicle, and any other potential objects that could be present. If there were any witnesses, attempt to obtain their contact details, which may prove helpful.

Your own health insurance

Notify your insurance company immediately in case of an accident, as this would help them forward their procedure as soon as possible. Depending on whether your policy covers medical expenses or uninsured motorist coverage, you might still be protected in a hit-and-run accident.

Finding the hit-and-run driver

Many times, in hit-and-run situations, the police cannot apprehend the culprit driver if the injured person is unable to provide the police with a licence plate number. It means, however, that there is still a way you can take to regain your compensation for the loss. An experienced car accident lawyer can help you navigate the legal process and explore all available options.

Uninsured motorist coverage

If you have uninsured motorist (UM) coverage in your auto insurance policy, you will likely get compensated for the following expenses:

  • Medical expenses
  • Lost wages
  • Cost of repairing your car when the at-fault driver cannot be identified.

UIM coverage can help if the driver who caused the accident has insurance but does not cover the total costs of the accident.
Hit-and-run coverage. There are insurance plans that some car owners sign up for that cater to hit-and-run cases, and these do not require the identification of the driver.

Why consult a lawyer after a “hit-and-run” accident

Hit-and-run instances are still common road incidents with general and legal complications. The right lawyer can inform you of what you are entitled to conduct research to assemble all the proof needed in support of your case. They can also handle correspondence with insurance companies and negotiate adequate compensation.

In hit-and-run cases, especially, it is advisable to seek the services of a lawyer who can represent you in court.
